Terms of Service

These Terms of Service ("Terms") govern your use of govansys.com and the services provided by Govan Systems Inc ("Govan Systems", "we", "us"). By using the site or our services you agree to them.

1. Services

Govan Systems provides IT consulting, cloud, security, AI, staffing services, and the software products described on this site. Specific engagements are governed by a separate written agreement, which prevails over these Terms where the two differ.

2. Acceptable use

• Do not use the site or services unlawfully, or to infringe anyone's rights.
• Do not attempt to gain unauthorised access to any system or account.
• Do not interfere with or disrupt the services, or transmit malicious code.

3. Accounts

Where a product requires an account, you are responsible for the credentials issued to you and for activity under your account. Tell us promptly at support@govansys.com if you believe an account has been compromised.

4. Text messaging (SMS/MMS)

Some of our products exchange text messages with the customers of the organisations that use them.

• Consent. Messages are sent only to people who have provided their mobile number and agreed to be contacted by text. Consent to receive messages is not a condition of purchase or of receiving any service.
• Message frequency varies with the activity the messages relate to. There is no fixed schedule.
• Message and data rates may apply, depending on your mobile plan and carrier.
• To stop, reply STOP to any message. One confirmation follows, then nothing further. Reply START to resume.
• For help, reply HELP, or contact the organisation that messaged you.
• Carriers are not liable for delayed or undelivered messages.
• No mobile information is sold or shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Text messaging is not a channel for emergencies. Where a product serves a clinical or veterinary context, urgent matters should be raised by telephone.

5. Intellectual property

The site, its content, and our software remain the property of Govan Systems or its licensors. Nothing here transfers ownership. Work product created under a client engagement is governed by that engagement's agreement.

6. Third-party services

Our products integrate with third-party services. Your use of those services is subject to their own terms, and we are not responsible for them.

7. Disclaimers

Except where a signed agreement says otherwise, the site and services are provided "as is" without warranties of any kind, express or implied. We do not warrant that they will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Govan Systems is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from use of the site or services.

9. Termination

We may suspend or end access to the site or a service where these Terms are breached. Engagement agreements govern termination of paid services.

10. Governing law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law rules.

11. Changes

We may revise these Terms. Material changes will be posted here with a revised date above, and continued use after that date constitutes acceptance.
